நீதிமன்ற தீர்ப்புக்கு எதிராக அழுத்தம் கொடுக்க எந்தவொரு நாட்டுக்கும் அதிகாரம் கிடையாது – ஜனாதிபதி மஹிந்த ராஜபக்ஷ

290909mahinda.jpgஇலங் கையின் நீதிமன்றத் தீர்ப்புக்கு எதிராக அழுத்தம் கொடுப்பதற்கு உலகின் எந்தவொரு நாட்டுக்கும் உரிமை கிடையாதென ஜனாதிபதி மஹிந்த ராஜபக்ஷ தெரிவித்தார். நீதித் துறையானது ஆயுத அச்சுறுத்தலுக்கு அடிபணித்திருந்த யுகத்துக்கு முற்றுப் புள்ளி வைக்க முடிந்துள்ளதாகத் தெரிவித்த ஜனாதிபதி, தாய்நாட்டுக்கெதிரான அழுத்தங்களின் போது இன, மத, குல பேதமின்றி இணைந்து முகங்கொடுக்க சகலரும் முன்வர வேண்டுமெனவும் தெரிவித்தார்.

சட்டத்தரணிகள் சங்க அலுவலகக் கட்டிடத்திற்கான அடிக்கல் நாட்டும் வைபவம் நேற்று கொழும்பு, புதுக்கடை நீதிமன்றக் கட்டிடத்திற்கருகாமையில் ஜனாதிபதி மஹிந்த ராஜபக்ஷ தலைமையில் நடைபெற்றது. மேற்படி கட்டிடத்திற்கான பெயர்ப்பலகையைத் திரைநீக்கம் செய்து வைத்து உரையாற்றுகையிலேயே ஜனாதிபதி இவ்வாறு தெரிவித்தார். இந்நிகழ்வில் ஜனாதிபதி மேலும் தெரிவித்ததாவது;

முப்பது வருட கால பயங்கரவாதத்திலிருந்து நாட்டை மீட்டு நாட்டில் நீதித்துறையின் அதிகாரத்தை உறுதிப்படுத்த எம்மால் முடிந்துள்ளது. இதனை, தேசிய ரீதியில் நாட்டை முன்னேற்றுவதற்கு சிறந்த யுகமாகக் கொள்ள முடியும். கடந்த 30 வருட காலம் இலங்கையின் நீதித்துறை பல்வேறு அச்சுறுத்தல்களுக்கு உள்ளாகியிருந்தது.

மக்களுக்கான நீதித்துறை என்ற நிலைமைக்கு மாறாக நாட்டில் ஒரு பகுதியில் சட்டம் நடைமுறை யற்றதாகியிருந்தது. சில காலகட்டங்களில் வவுனியாவிற்கு அப்பால் சட்டம் நடைமுறையில் இல்லாமல் இருந்தது. புலிகளின் தலைவர் பிரபாகரனுக்கு 200 வருட சிறைத் தண்டனை வழங்கிய போதும் அதனை நடைமுறைப்படுத்த முடியாத காலம் அது. பயங்கரவாதக் குழுவை பிடிப்பதற்கான தேவை இந்தியாவிற்கும் இருந்தது. எனினும், பிடியாணை உட்பட நீதிமன்ற செயற்பாடுகள் அப்போது கேலிக்குரியதாகின.

சட்டம் ஆயுத பலத்துக்கு அடி பணிந்திருந்த யுகத்துக்கு நாம் முடிவு கட்டினோம். இன்று சட்டத்திற்கெதிரான அச்சுறுத்தல்களை மேற்கொள்ள எவருக்கும் இடமில்லை. நீதிமன்ற நடவடிக்கைகள் நாடு முழுவதிலும் தற்போது செயற்படுவதுடன் சட்டம் நாட்டின் மூலை முடுக்கெல்லாம் செயற்படுத்தப்படுகிறது.

நீதிமன்றத்துக்கு அச்சுறுத்தல் ஏற்பட்ட பல சந்தர்ப்பங்களும் கண்டுள்ளோம். வடக்கு, கிழக்கில் பயங்கரவாதம் மற்றும் தெற்கில் பாதாள உலகம் என இவ்வச்சுறுத்தல் தொடர்ந்தன.  நீதிபதி சரத் அம்பேபிடிய போன்றவர்கள் பாதாள உலக குழுவினால் கொல்லப் பட்டார்கள். இது போன்ற நாட்டில் சட்டத்தை நிலைநாட்ட முயன்று துப்பாக்கிக்குப் பலியான பல சம்பங்களுண்டு. நாட்டில் பல நீதிமன்றங்கள் மூடப்பட்ட காலம் அது.

எல்லைக் கிராமம் என்பதை இலங்கையின் வரை படத்திலிருந்தே அகற்றி சட்டம் முழு நாட்டிற்குரியது என்பதை நாம் நடைமுறையில் கொண்டு வந்துள்ளோம். சட்டம் சகலருக்கும் பொதுவானதாக வேண்டும். நாம் தொழில்நுட்ப அறிவை கிராமிய மட்டத்திலும் கொண்டு சென்றுள்ளோம்.

இதனால் எதிர்வரும் காலங்களில் சட்டத்தரணிகள் அறிவு பூர்வமான மக்களுக்கே சேவை செய்ய வேண்டும் என்பதைக் குறிப்பிட விரும்புகிறேன். மக்களுக்கான உரிமை தொடர்பில் அவர்களை அறிவுறுத்த வேண்டியதும் சட்டத்தரணிகளின் கடமையாகிறது.

சிலர் நிறுவனச் சட்டங்களைக் கையிலெடுக்க முயல்கின்றனர். அதற்கான உரிமை எவருக்கும் கிடையாது. அரசாங்கம் நீதித்துறை போன்றே நீதித்துறை சார்ந்தவர்களின் கெளரவத்தையும் பாதுகாக்க வேண்டியுள்ளது. எனினும் நீதிமன்றத்தின் சுயாதீனத் தன்மையில் தலையிடவோ அழுத்தம் கொடுக்கவோ முடியாது.

ஆர்ப்பாட்டங்களை ஏற்பாடு செய்து ஊடகங்கள் மூலம் அழுத்தம் கொடுத்து நீதிமன்றத் தீர்ப்பினை மாற்ற கடந்த காலங்களில் பெரும் முயற்சிகள் மேற்கொள்ளப்பட்டன.

அது மட்டுமன்றி வேறு நாடுகளை தலையிடச் செய்து நம் நாட்டு நீதிமன்றத் தீர்ப்புக்களை மாற்றியமைக்கவும் முயற்சிகள் எடுக்கப்பட்டன. அவ்வாறு செய்தால் நாட்டின் சட்டம் என்னாவது? சட்டத்தின் முன் சலரும் சமம் என்ற கூற்றுக்கு என்ன அர்த்தம்? அப்படி நிகழ்ந்தால் சட்டத்தின் சமத்துவம் கேள்விக்குரியதாகிவிடும்.

எமது நாட்டில் சிறந்த நீதித்துறை உள்ளது. எந்தவொரு பாரதூரமான பிரச்சினையையும் தீர்த்துக் கொள்ளக்கூடியதான பலத்தை அது கொண்டுள்ளது. இதனால் இந்த நாட்டின் பிரச்சினையைத் தீர்க்க வேறு நாடுகளில் நீதிமன்றங்களை நிறுவ வேண்டிய அவசியமில்லை. எமது நாட்டின் நீதித்துறை சுயாதீனத்தைப் பாதுகாத்தால் மட்டுமே சட்டம் ஒழுக்கம் நிறைந்த நாடொன்றைக் கட்டியெழுப்ப முடியுமெனவும் ஜனாதிபதி தெரிவித்தார். எமது நாட்டிற்கெதிரான அழுத்தங்கள் தொடர்பில் நாம் விழிப்பாக இருக்க வேண்டும்.

இந்த விடயத்தில் இனம், மதம், குலம், கட்சி என்ற பேதங்கள் இருக்கக் கூடாது. எமது தாய் நாட்டிற்கு அழுத்தங்கள் வருமானால் நாம் அனைவரும் இணைந்து அதனை எதிர்கொள்ள வேண்டுமெனவும் ஜனாதிபதி மேலும் தெரிவித்தார்.

    Gen Fonseka has no options. If he needs GreenCard he has to testify. Even if he does not testify, there are enough evideces given by Pakiyisoothi Saravanamuthu and Jehan Perea to US State Dept against President’s brother Gotabaya. General Fonseka is sitting duck in US. We, thamil diasspora can pull him out anytime we want. Gen Fonseka may be a hero in Srilanka, but he is zero in US.

    FEW WEEKS AGO A CABINET MINISTER IN SRI LANKA SAID THAT ANY ONE AGAINST THE GOVERNMENT RULERS OF SRI LANKA,WHO LIVES IN OVERSEAS,MUST TAKE NOTE THAT SL GOVERNMENT CAN TAKE THEM TO SRI LANKA BY FORCE AND PUNISH THEM.NOW IT SEEMS THOSE WHO IN SRI LANKA WHO KILLED AND TORTURED THE PEOPLE MUST BE CAREFULL,BECAUSE OVERSEAS PEOPLE CAN TAKE THEM OUT OF SRI LANKA AND CAN PUNISH THEM FOR THEIR CRIMES.

    Unfortunately our Sri-lankan courts are not independant. if the courts had the power there wouldn’t evolved a militant Tamil force.Did the courts prosecute any one during 1958/77/83.NO, a definite No.SL is part of the world and as such will have to adhear to the world NORM.One language,religion and culture cannot try to anhilate another.SL is part of UN.So wake up to the real world.K S Tharmini

    Now my brothers and sisters are going to accept some hiden truth about war crimes committed by Sl forces during final stage of war. we cant hide it to international community . now everything is start to come to light. who did what . we all were cheated and did not get the truth how many innocent tamils dead in the war

    Yes Mr President, but you too are not above the law. Domestic laws are always on your side. Why are you getting jittery if you have done nothing wrong?

    If any independent investigation carried out all our heroes will become zeroes over night. Killing of civilians can’t be acceptable regardless of whether it was committed by LTTE or state mechanism. Any one who intentionally killed civilians are criminals and the state should try to protect those criminals.

    No international committees should be involved in Lankan issues. Just give us the money and get out of here … more money please! Ok … ok let’s solve all issues in Sri Lanka. Call Bamba or Angulana police!

    Politicians must understand that if they violate their citizen’s rights, they will find themselves confined to their countries only; as the civilized nations will either punish or ban them. Mr. President, we don’t know the full story yet! When Sri Lanka has only ‘jungle-law,’ we have to turn towards other countries for law and order.
