சட்டத்தரணி டேவிட் பேர்ஜஸ் கொலைச் சந்தேக நபர் பெண்ணாக மாறிய ஆண்!

நீதிமன்றத்திற்கு மீசை மற்றும் தாடி மயிர் முளைத்த முகத்துடன் கொண்டுவரப்பட்ட கனகசிங்கம் தன்னைப் பெண்ணாகவே அடையாளப்படுத்தும்படி நீதிமன்றைக் கேட்டுள்ளார்.

கிறிக்கல்வூட்டைச் சேர்ந்த கனகசிங்கம் வொன்ஸ்வேர்த் சிறைச்சாலையில் ஆண்கள் பகுதியில் தடுத்து வைக்கப்பட்டு உள்ளார். இவர் பெப்ரவரி 3 வரை வழக்கு விசாரணைகளுக்கு தடுத்து வைக்கப்பட்டு உள்ளார். இவரைப் பிணை எடுப்பதற்கான விண்ணப்பம் எதுவும் மேற்கொள்ளவில்லை.

ரெயிலில் தள்ளிவிடப்பட்டதால் மரணத்தை தழுவிய டேவிட் பேர்ஜஸ் ஆணாக இருந்த போதும் பெண்களின் உடைகளை அணிவதில் நாட்டம் கொண்டிருந்தவர். மாற்றுப்பால் இயல்புடைய டேவிட் பேர்ஜஸ் தன்னை இணையத்தில் பாலியல் உறவுக்கு விளம்பரப்படுத்தி இருந்தமை அவரது மரணத்தைத் தொடர்ந்து வெளிவந்தள்ளது.

டேவிட் பேர்ஜஸ் இன் தனிப்பட்ட பாலியல் இயல்புகளுக்கு அப்பால் அவர் தனது தொழிலில் நேர்மையாகவும் திறமையாகவும் இருந்ததை அவரது வேலை நண்பர்கள் மதிப்புடன் தெரிவித்துள்ளனர். அவருடைய பாலியல் நடத்தைகளையும் இரட்டை அடையாளத்தையும் அவரது குடும்பமும் வேலை நண்பர்களும் அறிந்தும் இருந்தனர்.

தஞ்சம் கோரிய பல நூற்றுக்கணக்கான தமிழர்களின் வாழ்வுக்கு வழிகாட்டிய சட்டத்தரணி டேவிட் பேர்ஜஸ் மரணத்தைத் தழுவினார்! அவருடைய மரணம் தொடர்பாக தமிழ்ப் பெண் கைது!

அரசியல் தஞ்ச வழக்குகளில் தனக்கென முத்திரை பதித்த சட்டத்தரணி டேவிட் பேர்ஜஸ் ஒக்ரோபர் 25ல் கிங்குறொஸ் நிலக்கீழ் ரெயில் நிலையத்தில் தண்டவாளத்தில் வீழ்ந்து உயிரிழந்தார். டேவிட் பேர்ஜஸ் இன் மரணம் தொடர்பாக தமிழ்ப் பெண் ஒருவர் கைது செய்யப்பட்டு உள்ளார். கிங்குரொஸ் நிலக்கீழ் ரெயில் நிலையத்தில் நின்ற டேவிட் பேர்ஜஸ்யை குறிப்பிட்ட தமிழ் பெண் புகையிரதத்தின் முன் தள்ளிவிட்டதாக தெரிவிக்கப்படுகிறது. இச்சந்தேக நபர் 34 வயதான நீனா கனகசிங்கம் எனப் பொலிஸார் தெரிவிக்கின்றனர்.

63 வயதான டேவிட் பேர்ஜஸ் 3 பிள்ளைகளின் தந்தை. மத்திய லண்டனில் வாழ்பவர். இவர் மாற்றுடையணியும் பழக்கம் கொண்டவர் என்றும் தெரியவருகிறது. சம்பவத்தின் போது பெண்ணுடை அணிந்து நின்ற டேவிட் பேர்ஜஸ் புகையிரத்தின் முன் வீழ்ந்ததால் புகையிரதத்தில் அடிபட்டு மரணமாகி உள்ளார். இவருடைய மரணம் தொடர்பாக நீனா கனகசிங்கம் மீது கொலைக் குற்றச்சாட்டு சுமத்தப்பட்டு உள்ளது.

David_Burgessடேவிட் பேஸ்ஜசின் மரணச் செய்தி பிரித்தானிய சட்டத்துறையினர் மத்தியில் அதிர்ச்சியை ஏற்படுத்தி உள்ளது. குறிப்பாக பிரித்தானிய தமிழ் சமூகத்திற்கு டேவிட் பேர்ஜஸ் வழங்கிய சட்ட சேவை அளவுக்கு எவருமே தன்னலமற்று பணியாற்றி இருக்கவில்லை. பலநூற்றுக்கணக்கான தமிழர்களுக்கு பிரித்தானிய மண்ணில் வாழும் உரிமையைப் பெற்றுக்கொடுத்த டேவிட் பேர்ஜஸ் தனது சட்ட நிபுணத்துவத்தால் எதிர்காலத்திலும் தஞ்சம் கோரும் பலருக்கு வாழும் உரிமையைப் பெற்றுக் கொடுக்க காரணமாய் இருந்தவர்.

1970க்களில் சட்டத்துறைக்குள் நுழைந்த இவர். ஏனையவர்களுடனும் இணைந்து வின்ஸ்ரான்லி பேர்ஜஸ் என்ற பிரித்தானியாவின் பெயர்பெற்ற குடிவரவுச் சட்ட நிறுவனத்தை நிறுவினார். அரசு சட்ட உதவிகளை இறுக்கமாக்கியதை அடுத்து தராதரமான சேவையை தங்களால் தொடர்ந்தும் வழங்க முடியாது என்ற நிலையில் வின்ஸ்ரான்லி பேர்ஜஸ் நிறுவனம் 2003 ஓகஸ்டில் மூடப்பட்டது.

அதன் மரணமாகும் வரை டேவிட் பேர்ஜஸ் லுக்மானி தொம்சன் அன் பார்ட்னர்ஸ் என்ற வூட் கிரீனில் உள்ள சட்ட நிறுவனத்தில் பணியாற்றி வந்தார்.

தமிழர்கள் பிரித்தானியாவுக்கு அரசியல் தஞ்சம் கோரிப் புறப்பட்ட எண்பதுக்களின் நடுப்பகுதி முதல் டேவிட் பேர்ஜர்ஸ் தமிழ் சமூகத்துடன் மிக நெருக்கமாகப் பணியாற்றியவர். தமிழர் தகவல் நடுவம் அரசியல் தஞ்சம் தொடர்பாக எடுத்துக் கொண்ட வழக்குகளை டேவிட் பேர்ஜஸ் பிரதிநிதித்துவப்படுத்தி வெற்றியும் கண்டார். உள்துறை அமைச்சின் பல்வேறு முடிவுகளையும் எதிர்த்து அவற்றை மாற்றி அமைக்கவும் காரணமாக இருந்தவர்.

எப்பொதுமே சவாலான விடயங்களையே தெரிவு செய்து வாதிடும் டேவிட் பேர்ஜஸ் அண்மைக்காலத்தில் கூட வெளிநாடுகளில் பாரபட்சமற்ற வழக்குகளுக்காகவும் அகதிச் சட்ட வரையறைக்குள் வராத வழக்குகளையும் பாதுகாப்பு அமைச்சின் சட்டவிரோதமான தடுத்துவைப்புகளுக்கு எதிரான சிவில் சட்ட வழக்குகளையும் பிரதிநிதித்துவப்படுத்தி வந்திருந்தார்.

டேவிட் பேர்ஜஸ் தீபெத்திய பெண்ணை மணந்தவர். அவருடைய மகள் (குசாங் நைமா) தனது தந்தையின் பெயரைப் பயன்படுத்தாமல் சட்டத்துறையில் சாதிக்க வேண்டும் என்று கடினமாக உழைப்பவர். அவர் தனது தந்தையின் பெயரைப் பயன்படுத்தி அதில் செல்வாக்குப் பெறாமலேயே அவரது கடின உழைப்பால் தான் டேவிட் பேர்ஜஸ் இன் மகள் என அறியப்படுபவர்.

சட்டத்துறையில் உள்ள அகதிகள் அமைப்புகளில் உள்ள தமிழ் சமூக அமைப்புகளில் உள்ள தமிழர்களுக்கு டேவிட் பேர்ஜஸ் மிக அறிமுகமானவர். அவருடைய இழப்பு தமிழ் சமூகத்திற்கு ஆழ்ந்த சோகமே.

சந்தேக நபரான நீனா கனகசிங்கம் கிரிக்கல்வூட் பகுதியில் உள்ள சிசிலி வீதியில் வாழ்பவர் எனத் தெரியவருகின்றது. நவம்பர் 1ம் திகதி இவர் ஓல்ட் பெய்லியில் ஆஜர்படுத்தப்பட உள்ளார்.

    Throughout her three years of struggle Susheeladevi failed to secure protection in this country for one principal reason. None of her lawyers took a statement from her. The significance of a full statement is obvious and cannot be overstated. Arguably this is so for any work undertaken by lawyers but it is crucial for asylum seekers. As the JCWI Handbook points out, inconsistencies will be used to cast doubts on credibility and elaborations of an initially sparse account may well be characterised as exaggeration.3

    Susheeladevi states that over the three-year period she received a grand total of less than one hour’s “quality time” with her solicitors. That included the only occasion when Susheeladevi saw the first solicitor having responsibility for her case. She states that she was seen with another client and the attendance lasted “barely two minutes”. During that time both clients signed Green Forms. Susheeladevi’s first and chief asylum statement was written by her at her solicitor’s request. The advice given her by her solicitor was to put in “whatever was said at the airport”. Susheeladevi states that at no time did her first solicitors or her second or third firm of solicitors, sit with her and take full details of her asylum claim.4

    According to Susheeladevi the solicitors were, however, assiduous in one respect. Not only did Susheeladevi sign green forms with each of the solicitors but her recollection is that with the first and second firms of solicitors she signed more than one. She parted company with the first firm of solicitors when they told her that she would have to pay £640 for a barrister to represent her at her immigration appeal and more if the appeal was adjourned.5

    No one advised her that the Refugee Legal Centre or the Free Representation Unit might be able to help her without charge, or that there are more junior counsel who might be prepared to act more cheaply.

    Susheeladevi states that the second firm of solicitors who did arrange representation for the hearing took money from her on two occasions, requesting payment in cash.6

    If the solicitors were a chief cause of Susheeladevi’s difficulties, there is little to suggest an energetic attempt by her barrister to repair the evidentiary problems. In the days leading up to the hearing before the Adjudicator, Susheeladevi had a conference with her barrister. No interpreter was arranged, but fortunately Susheeladevi had a friend with her who spoke English. Susheeladevi states that the conference lasted ten minutes and that the barrister “had her bag and was getting ready to go”.7

    Susheeladevi remembers very little of the Divisional Court stage of her case: “there was no questioning, only barristers talking to each other in English.” Whilst the QC is to be congratulated for having recently raised in the Court of Appeal the question of whether a rape and torture victim might have experienced difficulties in pleading the detail of her cause, the cost of employing a QC can scarcely be justified on the basis of so fundamental, yet at the same time so ordinary an insight. The core problem remained outstanding. The single most important voice, that of Susheeladevi, had still not been heard.8

    Susheeladevi’s story is not simply a tale of indifferent work by the legal profession. Had the fundamental preparation been caried out, the cause of Susheeladevi’s evidentiary difficulties could have been explained to the Home Office and if necessary to the Special Adjudicator.9 Susheeladevi was interviewed at the airport on her arrival in 1993. Power situations are a feature of the asylum determination process and the Home Office interpreter exploited this one to the full. He told her that she should not mention anything about army assaults. He said that she should blame the Tamil Tigers or any other rebel groups for the problems she had suffered, but not the Sri Lankan government as the British Government would not like that. He told her to say that she had come as a student because she had trouble with the Tigers. Subsequently as advised by her first solicitors, Susheeladevi struggled to remain faithful to this version of her problems when drafting her written statement.

    When Susheeladevi went for her full asylum interview, the same interpreter appeared.10 Her account of what took place is as follows. When Susheeladevi started to explain what had happened the interpreter banged the table with his hand and told her to finish quickly because he had another appointment and that she was not to say so much. Susheeladevi says that the man was so rude she felt he was going to assault her.

    A man accused of pushing a transgender human rights lawyer under a Tube train is in the process of becoming a woman, a court heard today.
    Unshaven Nina Kanagasingham, 34, of Chichele Road, Cricklewood, north-west London, appeared at the Old Bailey today charged with the murder of David Burgess – also known as Sonia.
    This is the first time since his arrest that it has been revealed Kanagasingham is actually a man.

    Judge Timothy Pontius asked: ‘This defendant is in the process of undergoing a sex change. Has it been completed?’
    He was told it had not, and that the defendant wished to be referred to as Nina.
    Mr Burgess, 63, was struck by a train at King’s Cross Underground station during evening rush-hour last Monday.
    He was a human rights lawyer known professionally by his birth name of David.
    Since Mr Burgess’s death, it has emerged he offered his services on a website, where he advertised himself as a ‘pre-op’ transsexual escort looking for paid encounters with men.
    Mr Burgess, who had two adult daughters and a son by his ex-wife, was a senior partner in his firm, with more than 40 years’ experience in immigration law. He had brought human rights cases against North Korea.
    His family knew him as both Sonia and David.

    Mr Burgess had been dressing in women’s clothing for four years and had set up profiles on two transgender websites as Sonia Jardiniere.
    On the website Birchplace, which bills itself as a ‘lifestyle fetish community’, the solicitor advertised himself as an escort and posted several photographs of himself as a woman, describing himself as having a ‘party doll’ personality.
    His page was titled ‘Sonia (escort) – TV – London’ and he described himself as a private Capricorn, slim, brown-eyed and ironic.

    Under the heading ‘things I like’, he wrote: ‘Fashion, makeup, shopping, romance, Look magazine, romantic films and most guys but let’s not forget girls a guy is for 40mns [though maybe the next one will fall in love with me…] but a wardrobe is for a season.’
    Under his dislikes he states: ‘Not many, really. Unkindness.’
    Other users of the site responded positively to Mr Burgess’s page, writing, ‘Hot stuff’, ‘absolutely gorgeous’, ‘my dream date’, ‘we just have to meet’, ‘you sound like fun’, ‘very sexy’ and ‘fancy a s**g?’

    On another transgender website, Mr Burgess wrote he was seeking ‘mature admirers’ and was looking for casual and serious relationships.

    His former wife and children said in a statement: ‘Sonia (David) was a loving and wonderful person and will be missed deeply.’
    Mr Burgess had worked for his law firm in Wood Green, north London, having previously been senior partner at the renowned immigration firm, Winstanley Burgess Solicitors.

    His work since the 1970s had led to significant judgments in the House of Lords, the European Court of Human Rights in Strasbourg and the European Court of Justice in Luxembourg.
    A citation on his employer’s website said his abilities ‘bring an added depth to our firm’.
    He had been involved in cases regarding fair trials in foreign countries, people facing exclusion from the Refugee Convention, civil claims against the Ministry of Defence for unlawful detention, as well as country guidance casework on North Korea.
    A commendation by London barrister Raza Hussain Q.C. reads: ‘David Burgess was a partner in the firm Winstanley Burgess Solicitors, the gold standard immigration law firm in the 1990s.
    ‘He was responsible for what was described by Professor Sir William Wade as the most important constitutional case for centuries (M v. Home Office), which began with David’s attendance out of hours before a Duty Judge challenging the unlawful removal of his client to Zaire.

    ‘M Orders’ have entered the lexicon of public law. David had personal conduct of the evidential aspect of the argument in Chahal v UK, perhaps the most important European immigration law case of the last few decades.
    ‘David has superb analytical skills, and total commitment to his cases.’
    King’s Cross station had to be evacuated and the Piccadilly line closed as police recovered Mr Burgess’s body after the incident.
    Kanagasingham was remanded in custody at Wandsworth men’s prison for a plea and case management hearing on February 3 next year. No bail application was made.

    நான் அறிந்தவரை டேவிட் அவர்களும் நினா கனகசிங்கமும் முன்பே பழக்கமானவர்கள். அவர்களின் இருவருமே ஆணாக இருந்தும் பெண் போல தோற்றமளிப்பதில் ஈடுபாடு உள்ளவர்கள். அதுதவிர இருவரும் பகிடி செய்துகொண்டு செல்லும்போதே டேவிட் அவர்கள் தண்டவாளத்திலே விழுந்ததாக கூறப்படுகிறது. இது ஒரு விபத்து என்றே இப்போது கருதப்படுகிறது.
